Empara is committed to maintaining the privacy and security of your personal information and understands that health information is sensitive. This privacy policy describes what information Empara may collect from you, how it may be used, and the rights and obligations of you and Empara with regard to that information.
This privacy policy governs the use of the website (the “Site”) belonging to Empara, LLC (“Empara”) as well as Empara’s mobile application (the “App”), and the services and products Empara makes available to users through the Site and the App. For purposes of this privacy policy, the Site, the App, and the associated services and products will be referred to as the “Services”.
Acceptance of privacy policy
By using the Services, you agree to the terms of this privacy policy and agree that Empara may use your personal information to provide Services to you, to run our business, and to communicate with you. If you do not agree to the terms of this privacy policy, please do not use the Services. Your continued use of the Services after changes are made to this privacy policy means you accept those changes as well.
Empara’s Collection of Information
Empara collects information via the Site and the App, which includes personally identifiable information of users in order to provide the Services in an effective and secure manner. Personally identifiable information (“PII”) means sensitive personal information of users, such as social security numbers, account numbers, Protected Health Information (as defined by 45 C.F.R. § 160.103 (“PHI”)), financial data, date of birth, passwords.
Personal Information Provided by You
In order to use the Services, you may be asked to complete a registration form and provide personal information, such as contact information (e.g., name, ID number, etc.). Empara uses this information to provide secured access to the Services.
Personal Information Provided by Third Parties
Empara may receive information about you from third parties if you elect to use the Site or request Empara Services. For instance, we may receive PII from health insurance plans or health care providers. However, Empara is not a health care provider or health insurance plan. Any health care services that are made available through our Services are provided by independent, third-party health care providers who will provide you with their notice or privacy practices that describes its practices related to collection or use of your PHI and PII.
Use and Disclosure of Personal Information
Empara may use your information to respond to your requests for information, in connection with providing Services, or for operating our business. PII will be used and maintained by Empara in accordance with all applicable laws and regulations regarding privacy and security, including the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), as amended by the Health Information Technology for Economic and Clinical Health Act of 2009 (“HITECH”).
The nature of the Services Empara provides allows other organizations and individuals to use the Site and/or the App to collect your personal information, but only when you elect to use a linked or offered third party service provider. Empara may share your information with third parties under certain circumstances, such as: (i) with other companies that work with us or on our behalf to help us to provide Services or operate our business, (ii) disclosures to a user’s health plan for purposes of providing the Services, (iii) in response to an emergency that involves someone’s safety, or (iv) in response to a legal demand or action, whether from a court or governmental agency or a private party. When we share personal information, we will use all commercially reasonable efforts to require the person or entity with whom information is shared handles your information with at least the level of security as it applies to its own confidential information.
Only Empara employees who need the information to perform a specific authorized task (for example, billing or customer service) are granted access to personally identifiable information, and all Empara employees are regularly trained on our security and privacy practices. Empara may share certain aggregated data to third parties, but only if it does not contain personally identifiable information (“de-identified data”).
Automatically Collected Information and Anonymous Information
Each time a user visits the Site or the App, Empara collects some information to improve user experience. Some types of data that Empara may collect are:
Site or App Data. Empara reviews the traffic on its Site and the App and may combine information about you into a set of aggregated group data. If made anonymous, group data may be shared with third parties.
Web Logs and Internet Protocol (“IP”) Addresses. An IP address is a number that automatically identifies the computer/machine you have used to access the Internet. The IP address allows a server to send you web pages. Empara may use IP addresses in connection with provision of Services.
Cookies. Cookies are pieces of information that are sent to a computer to remember information about preferences. Cookies identify a user’s computer, but not the user. Many websites use cookies as a standard practice and most web browsers are set up to accept cookies. You can refuse cookies by adjusting your browser settings, which may affect user experience.
Links to Other Sites
Our Site and App hyperlinks other connections to sites maintained by third parties. This privacy policy only covers our Site and App. While Empara will make every effort to keep your information secure, we do not control the policies of other parties and we recommend you review those policies in addition to this one.
Security
Empara stores the data it collects using industry standard physical, technical and administrative safeguards to prevent risks such as unauthorized use, access, disclosure, destruction or modification. While Empara is not a covered entity or business associate, our data security measures are consistent with the standards of the HIPAA security regulations. Empara will always use reasonable care in providing secure transmission of information between your computer and our servers, but we cannot guarantee that information transmitted to us over the Internet will be secure.
Response to “Do Not Track” Signals
At this time, Empara does not process or respond to “Do Not Track” signals.
Children
Empara is committed to protecting children’s personal information and complying with the Children's Online Privacy Protection Act ("COPPA"). Empara services are not intended for children under 13 years of age. If you are under 18 years of age, we ask that you get parental consent for use of the Services. If you are under 18 and do not have parental consent, do not provide any personal information to Empara and do not use the Services.
European Union and California: Empara’s Services are intended for use in the United States and are not intended for users outside the United States, including the European Union. If you are a California resident, you may request that we provide you with certain information about the entities with which we have shared our customers’ personal information for direct marketing purposes during the preceding calendar year. To do so, please contact us as directed below.
Changes
You may opt out of receiving communications from Empara. You may also review and request changes to your information that Empara has collected, including the removal of your data from the Site or the App, using any of the following options:
